Step 1: Understanding PIL
Public Interest Litigation (PIL) allows individuals or organizations to file a petition in the court on behalf of those whose rights have been violated but are unable to approach the court themselves. PIL plays an important role in safeguarding the rights of marginalized and vulnerable sections of society.
Step 2: The First PIL Case in India
The concept of PIL was first introduced in India through the Bandhua Mukti Morcha Case (1984). In this case, the Supreme Court took suo motu cognizance of the plight of bonded laborers and addressed their rights under PIL, even though the affected people did not directly file the case.
Step 3: Importance of PIL
The Bandhua Mukti Morcha Case marked a significant shift in Indian jurisprudence, as it allowed courts to take action in cases where public interest was at stake, even without a formal petitioner. This expanded access to justice and allowed courts to directly address social justice issues.
